1. Acceptance of these terms

These Terms of Use ("Terms") govern your use of the Dalaguete HRIS mobile application ("the App"), provided by the Municipality of Dalaguete ("the LGU") and developed by ITSM. By installing, signing in to, or using the App, you agree to these Terms and to the Privacy Policy. If you do not agree, do not use the App.

2. Who may use the App

The App is provided solely for active employees and authorized personnel of the Municipality of Dalaguete, for official, work-related purposes. Access is granted, managed, and may be withdrawn by the LGU. You may use the App only with an account issued to you and only while you are authorized to do so.

3. Your account and credentials

  • You are responsible for keeping your username, PIN, and device secure, and for all activity that occurs under your account.
  • Do not share your credentials or allow anyone else to use your account or device to access the App.
  • Enabling biometric (fingerprint/face) sign-in means anyone whose biometrics are enrolled on your device may be able to unlock the App — only enable it on a device that is solely yours.
  • Notify the LGU's HR or MIS office immediately if you believe your account or device has been lost, stolen, or compromised.

4. License

The LGU grants you a limited, personal, non-exclusive, non-transferable, and revocable license to install and use the App on your registered device for official purposes, subject to these Terms. All rights not expressly granted are reserved.

5. Attendance integrity

Attendance and related entries recorded through the App are official records. You agree that all information you submit — including time punches, locator and movement entries, and leave and CDO applications — is true, accurate, and made by you for yourself.

Falsifying attendance, misrepresenting your location, or submitting entries on behalf of another person may constitute an administrative offense and may be dealt with under applicable Civil Service Commission rules and LGU policies, in addition to any consequences under these Terms.

6. Acceptable use & prohibited conduct

When using the App, you must not:

  • Punch attendance for, or impersonate, another employee ("buddy punching"), or let another person punch for you.
  • Use fake, mock, simulated, or spoofed GPS/location, or otherwise attempt to defeat location verification or geofencing.
  • Bypass, disable, or tamper with the App's security, device binding, or integrity checks, including by using a rooted, jailbroken, or modified device or environment for that purpose.
  • Access, or attempt to access, accounts, data, or parts of the system you are not authorized to use.
  • Reverse engineer, decompile, modify, copy, or create derivative works of the App, except to the extent the law expressly permits.
  • Interfere with, overload, or disrupt the App or its servers, or introduce malicious code.
  • Use the App for any unlawful, fraudulent, or unauthorized purpose.

7. Device binding

To protect attendance integrity, your account may be bound to a single registered device. Changing or re-registering your device may require approval from the LGU's HR or MIS office. Attempting to circumvent device binding is prohibited.

8. Availability, updates & changes to the App

The App is provided as an operational tool and may be unavailable at times due to maintenance, updates, network conditions, or factors beyond our control. We may add, change, suspend, or remove features, and may require you to install updates to continue using the App. We do not guarantee uninterrupted or error-free operation.

9. Intellectual property & data ownership

The App, including its software, design, and content, is owned by ITSM and/or the LGU and is protected by intellectual-property laws. These Terms do not transfer any ownership to you.

Employment, attendance, and HR records processed through the App are owned and controlled by the LGU and handled as described in the Privacy Policy.

10. Privacy

Your use of the App is also governed by our Privacy Policy, which explains what information the App collects (including location) and how it is used and protected. Please review it carefully.

11. Suspension & termination of access

The LGU may suspend or terminate your access to the App at any time — for example, if you violate these Terms, if your account or device is compromised, or upon your separation, transfer, or change of status. Upon termination, your license ends and you must stop using the App. Provisions that by their nature should survive (such as record obligations, intellectual property, disclaimers, and limitation of liability) will continue to apply.

12. Disclaimers & limitation of liability

To the fullest extent permitted by law, the App is provided "as is" and "as available," without warranties of any kind, whether express or implied. To the fullest extent permitted by law, the LGU and ITSM will not be liable for indirect, incidental, or consequential damages, or for loss arising from your use of, or inability to use, the App, including any device, network, or location-accuracy issues. Nothing in these Terms limits any liability that cannot be limited under applicable law, or your rights and the LGU's obligations under the Data Privacy Act.

13. Governing law

These Terms are governed by the laws of the Republic of the Philippines, without regard to conflict-of-law principles. Any dispute will be subject to the appropriate courts and administrative bodies of the Philippines, and to applicable civil-service rules and procedures.

14. Changes to these terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, notify you within the App. Your continued use of the App after an update means you accept the revised Terms.
